Terms and Conditions

This is an English translation provided for information. The Czech version is legally binding.

Introductory provisions

These terms and conditions govern, in accordance with § 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter the "Civil Code"), the mutual rights and obligations of the seller and the buyer arising in connection with the conclusion of a purchase contract through the e-shop at https://idcshop.cz.

Seller (operator of the e-shop):

ACES Services spol. s r.o.
Company ID (IČO): 27242471

Registered office: Za Nadýmačem 1130/13, Uhříněves, 104 00 Praha 10

The company is registered for VAT.

The buyer is either a consumer (a natural person acting outside the scope of their business activity) or a business (a legal entity or a self-employed person acting within the scope of their business activity).

Provisions deviating from these terms and conditions may be agreed in an individual contract; such deviating arrangements take precedence.

Conclusion of the purchase contract

The presentation of goods in the e-shop is for information only and does not constitute an offer to conclude a contract; § 1732(2) of the Civil Code does not apply. The seller is not obliged to conclude a purchase contract.

The buyer creates an order by completing and submitting the order form. Before submitting it, the buyer must check and correct the details entered. The seller considers the details stated in the order to be correct.

By submitting the order, the buyer makes an offer to conclude a purchase contract. The purchase contract is concluded at the moment the seller accepts the order by an order confirmation e-mail – for goods in stock usually immediately after the order is submitted, for goods to order by a separate e-mail after the seller has verified their price and availability with the supplier. The e-mail "Order received – awaiting confirmation" only confirms that the order has been delivered and does not constitute its acceptance. If the seller cannot accept the order (in particular due to an obvious pricing error, a change in price or the goods being unavailable from the supplier), the seller will notify the buyer without undue delay and refund any amount already paid in full without undue delay. A concluded purchase contract (including the agreed price) may only be amended by written agreement.

The buyer agrees to the use of means of distance communication when concluding the purchase contract; any costs incurred by the buyer in using such means (internet, calls) are borne by the buyer and do not differ from the standard rate.

We deliver goods only within the Czech Republic. If you are interested in delivery abroad, please contact us by e-mail.

Price of goods and payment terms

Prices of goods are stated in Czech crowns (CZK) including VAT and all related charges. For electrical and electronic equipment, the price includes the recycling contribution for take-back (under Act No. 542/2020 Coll., on End-of-Life Products), the amount of which is shown separately on the tax document.

For used (second-hand) goods, the seller may apply the special scheme under § 90 of the VAT Act; in that case the tax document does not show a VAT breakdown.

The price of the goods and any delivery costs can be paid:

By payment card online (Visa, Mastercard), including Apple Pay and Google Pay, or by an online bank button — payments are processed by the licensed payment institution Comgate a.s. After completing your order, you will be redirected to the secure payment gateway.
By bank transfer to the seller's account stated in the order confirmation. Due date: within 7 calendar days of the order confirmation. Variable symbol = order number without the hyphen.

Goods are dispatched or made ready for collection only after the payment has been credited (for cards, immediately after the payment is authorised). If payment is not made within 7 days, the seller is entitled to withdraw from the contract.

The buyer receives the tax document (invoice) by e-mail after the goods have been dispatched.

Carriage and delivery of goods

Delivery methods and prices are listed on the Shipping and payment page.

The delivery period is:

for goods in stock: 1–3 working days from the payment being credited
for goods to order (including custom-built PCs): the period stated for the product

When taking over the goods from the carrier, the buyer must check the condition of the consignment and, if the packaging is damaged, draw up a damage report with the carrier. Later complaints about mechanical damage are difficult for us to resolve.

Ownership of the goods passes to the buyer upon taking over the goods.

Electronic licences

  1. An electronic licence is a licence key (or a download link) for software, a subscription or a game that the seller delivers electronically, without a tangible medium. Such goods are marked "Electronic licence – delivered by e-mail" in the shop and in the order.
  2. A licence can only be paid in advance – by card or bank transfer; cash on delivery and paying on collection are not available. No shipping is charged for a licence.
  3. The seller sends the licence key to the e-mail address given in the order once the payment has arrived, usually within hours on working days and as a rule no later than the next working day. If the licence cannot be delivered in that time, the seller informs the buyer without undue delay. The key is always available in the customer account under My licences, or via the link in the licence e-mail.
  4. Some licences (e.g. ESET) are issued by the vendor to a specific person or company. The buyer gives these details in the order and is responsible for their accuracy.
  5. Before sending the order, the consumer expressly agrees that the licence is delivered immediately after payment, i.e. before the withdrawal period ends, and acknowledges that by the delivery of the licence they lose the right to withdraw from this part of the contract (Section 1837(l) of the Czech Civil Code). A licence cannot be ordered without this consent. The seller confirms the consent in the order confirmation e-mail and again in the licence e-mail. Until the licence has been delivered, the consumer may withdraw from this part of the contract and the seller refunds the price paid. The other goods in the same order keep the usual 14-day period.
  6. Rights arising from defective performance of a licence (e.g. a key that cannot be activated) are governed by Section 2389a et seq. of the Czech Civil Code. The buyer reports the defect by a complaint (the form on the website or info@idcshop.cz) within two years of delivery, for a subscription during its term. The seller checks the key and delivers a key free of defects; if that is not possible, it grants a reasonable discount or refunds the price.
  7. The use of a licence is governed by the vendor's licence terms, which the buyer accepts on activation.

Withdrawal from the purchase contract by a consumer

In accordance with § 1829(1) of the Civil Code, a consumer has the right to withdraw from the purchase contract without giving any reason within 14 days of taking over the goods.

To withdraw from the contract, you may use:

the model withdrawal form (under Government Regulation No. 29/2023 Coll.), sent by e-mail to info@idcshop.cz,
or any other unequivocal statement of withdrawal sent to info@idcshop.cz.

We will confirm receipt of the withdrawal to the buyer by e-mail without undue delay. The deadline is met if the buyer sends the withdrawal before the 14-day period expires.

Return of goods:

The buyer shall send the goods back to the seller without undue delay, no later than 14 days after withdrawing from the contract.
The costs of returning the goods are borne by the buyer, including where the goods cannot be returned by ordinary post due to their nature.
The goods should be returned undamaged, unworn and, if possible, in their original packaging.
The buyer is liable for any diminished value of the goods resulting from handling them other than as necessary to establish their nature, characteristics and functioning.

Refund:

The seller will refund to the buyer all money received, including delivery costs (up to the amount of the cheapest delivery method offered), within 14 days of the withdrawal from the contract.
The refund is made by the same means by which the payment was received (card payments back to the card, transfers to the account), unless the buyer agrees otherwise.
The seller is not obliged to refund the money before the buyer hands over the goods or proves that they have been sent.

A consumer cannot withdraw from the contract in the cases listed in § 1837 of the Civil Code — in particular for goods modified according to the buyer's wishes (e.g. a custom PC configuration built to order with non-standard components), and for a sealed audio or video recording or computer software where the protective packaging has been broken.

Rights arising from defective performance (complaints)

Rights and obligations relating to defective performance are governed by § 2161 et seq. of the Civil Code and by the Complaints Procedure, which forms an integral part of these terms and conditions.

Summary:

New goods — consumer: rights arising from defective performance may be exercised within 24 months of taking over the goods.
New goods — business: 12 months (contractual warranty).
Second-hand (used) goods: the period for exercising rights arising from defective performance is 12 months (§ 2168 of the Civil Code); the rights do not cover wear corresponding to the condition grade (A / B / C) stated at the time of sale.
We handle complaints within 30 calendar days; a complaint can be made by e-mail to info@idcshop.cz. For the detailed procedure, see the Complaints Procedure.

Take-back of electrical equipment

In accordance with Act No. 542/2020 Coll., the seller provides free take-back of waste electrical and electronic equipment. Details — including take-back points and the amounts of recycling contributions — can be found on the Take-back of electrical equipment page.

Out-of-court resolution of consumer disputes

We try to resolve disputes between the seller and a consumer amicably. If we do not reach an agreement, the consumer has the right to turn to the Czech Trade Inspection Authority (ČOI), which is responsible for the out-of-court resolution of consumer disputes:

Česká obchodní inspekce, Ústřední inspektorát — oddělení ADR (Czech Trade Inspection Authority, Central Inspectorate — ADR Department)
Štěpánská 567/15, 120 00 Praha 2
Web: adr.coi.cz
E-mail: adr@coi.cz

Personal data protection

The processing of the buyer's personal data by the seller is governed by the principles set out on the Privacy Policy page.

Delivery of correspondence

The contracting parties may deliver all written correspondence to each other by e-mail. The buyer delivers to the seller at info@idcshop.cz. The seller delivers to the buyer at the e-mail address stated in the order.

Final provisions

Relationships and any disputes arising from the contract shall be governed exclusively by the law of the Czech Republic and shall be resolved by the competent courts of the Czech Republic.

Any disputes between the seller and a buyer who is a consumer may also be resolved out of court (see Article 8).

The contract is concluded in the Czech language. If a translation of the contract is made for the buyer's purposes, the Czech version prevails in the event of any conflict.

The seller is not bound by any code of conduct in relation to the buyer within the meaning of Section 1820(1)(n) of the Civil Code.

The purchase contract, including these terms and conditions, is archived by the seller in electronic form and is not accessible to third parties. The buyer receives it in the order confirmation e-mail and can access it in the customer account under My orders.

The seller reserves the right to amend these terms and conditions at any time. Amendments do not apply to contracts already concluded.

These terms and conditions take effect on the date of their publication.
